Probate lawyer fees in Ontario depend on the work involved, the complexity of the estate, and the lawyer’s billing arrangement. Before comparing quotes, check whether the fee covers only the probate application or also includes help administering the estate after the court issues a certificate.
Legal fees are separate from Ontario’s Estate Administration Tax and other expenses. Understanding these different costs helps you compare services and ask informed questions before hiring an estate lawyer.
This guide explains the main costs to consider, what can affect your legal bill, and what to ask when requesting a quote for probate assistance in Ontario.
What Is Probate in Ontario?
Probate is a court procedure used to establish or confirm someone’s authority to act as an estate trustee and, where there is a will, formally approve it as the deceased person’s valid last will.
Estate administration is the broader work of handling the estate. It can include identifying assets, addressing debts and taxes, keeping accounts, and distributing what remains. Obtaining a probate certificate is only one possible part of that work.
An estate can require a court appointment whether or not the deceased left a will. Probate is not required for every estate.
For more information, see Ontario’s official guide to applying for probate of an estate.
How Much Are Probate Lawyer Fees in Ontario?
There is no single price that applies to every probate matter. A useful quote should identify the services included, how fees are calculated, and which expenses are additional.
Comparing a quote for preparing a probate application with a quote for helping administer the entire estate can be misleading. Ask each lawyer to explain the scope before comparing prices.
Probate Application Assistance
Ask whether the quoted fee includes:
- Reviewing the will and relevant documents.
- Advising on the appropriate application.
- Preparing application forms and supporting documents.
- Helping with required notices and filing.
- Responding to routine court requests or corrections.
Do not assume every task is included in a fixed fee.
Broader Estate Administration
Ask whether additional work is included or billed separately, such as:
- Communicating with financial institutions and beneficiaries.
- Advising on estate accounts and distributions.
- Coordinating with an accountant.
- Assisting with property or business interests.
- Addressing disputes or unexpected complications.
Small Estates: A Separate Court Process
Ontario offers an optional simplified probate process for estates valued at $150,000 or less.
This does not set the lawyer’s fee. It is also different from the $50,000 Estate Administration Tax exemption.
Read Ontario’s guidance on probate of a small estate.
How Estate Lawyers Charge
A lawyer’s proposal may use one or more billing arrangements:
- Fixed fee: A stated price for defined services. Ask about exclusions and additional charges.
- Hourly billing: Charges based on time spent. Ask for the applicable rates and an estimate.
- Combined arrangement: A fixed fee for certain tasks and hourly billing for others.
Request written terms explaining the scope, billing method, applicable taxes, disbursements, and when payment is required. Ask how you will be notified if the estimate changes.
Additional Probate Costs in Ontario
Estate Administration Tax
Estate Administration Tax is separate from the lawyer’s bill.
For estate certificate applications made on or after January 1, 2020:
- No Estate Administration Tax is payable on the first $50,000 of estate value.
- Above that amount, the tax is $15 for each $1,000, or part thereof, exceeding $50,000.
For example, if the estate value used for this tax is $300,000, the tax is $3,750. This excludes legal fees and other expenses.
Determining which assets count requires care. Check Ontario’s Estate Administration Tax guidance and obtain advice where needed.
Disbursements and Other Professional Costs
Depending on the work required, additional expenses may include searches, certified documents, delivery, valuations, accounting, or other third-party services.
Ask for an itemized estimate. Clarify which expenses the lawyer will pay on your behalf and which you must arrange separately.
What Can Affect Probate Lawyer Fees?
When requesting a quote, explain whether the estate involves:
- An original will and any amendments.
- Several accounts, properties, or business interests.
- Missing or incomplete records.
- Assets or beneficiaries outside Ontario.
- Disagreements about the will or administration.
- Questions about who should apply as estate trustee.
These details help the lawyer assess the likely work. Estate value alone does not explain every difference between quotes.
Questions to Ask Before Hiring a Probate Lawyer
- Does your quote cover the application only or broader estate administration?
- What work is excluded?
- Is billing fixed, hourly, or a combination?
- Are taxes and disbursements additional?
- Who will work on the matter, and at what rates?
- What happens if the court requests further documents?
- Are disputes, property transactions, and accounting billed separately?
- Is an advance payment required?
- How will you communicate changes to the estimate?
Keep a copy of the written agreement and ask about anything you do not understand.

Frequently Asked Questions
How much does it cost to probate a will in Ontario?
The total can include legal fees, Estate Administration Tax, and additional expenses. Request a written quote based on the estate and the services needed.
Is probate tax included in the lawyer’s fee?
Do not assume it is. Ask the lawyer to show professional fees, applicable taxes, Estate Administration Tax, and disbursements separately.
Are probate lawyer fees a percentage of the estate?
Ask the lawyer how the proposed fee is calculated. Do not assume that a percentage mentioned online applies to your matter, or confuse legal fees with estate trustee compensation.
Does an estate below $50,000 have no probate costs?
The tax exemption does not mean that legal services or other expenses are free. Whether a probate application is needed is a separate question.
Is probate the same as administering an estate?
No. Probate concerns court authority and, where applicable, approval of the will. Estate administration covers the broader work of handling the estate.
How can I compare probate lawyer quotes?
Compare the same scope of work. Check exclusions, billing rates, additional expenses, and how unexpected work will be charged.
